(“Prelib“) and aims to provide information about Prelib, its business, services and products, as well as to interact with its customers. This Website includes text, images, audio and video excerpts, software, graphics, interfaces, or the code and choice of content and its layout and other elements (collectively, the “Content“) provided by Prelib or used under license by it, the whole for information purposes only.

The present Terms govern your use of all features of the Website, as provided by Prelib. Please take the time to read these Terms of use carefully as they contain terms and conditions relating to your use of the Content, the Website or your browsing on it.

The purpose of the Website is to facilitate the dissemination of general information about the products and services offered by Prelib in the normal course of its business and to initiate contact between Prelib and its customers. In this regard, you may view it, subject to what is described below, download and print certain portions of it.

The information found on the Website and the Content is for informational purposes only and is provided to you as is and as it is available. Prelib makes no representation or warranty as to the accuracy or completeness of the information on the Website or the Content thereof. In this regard, as more fully mentioned in Section 6 below, you understand that the Content of the Website must not at any time replace the opinion of a health professional.

As part of your use of the Website and the Content, you agree to the following:

  • Not to use the Website or the Content, or to permit or facilitate its use by any person, in a manner that would constitute or encourage to perpetrate a criminal or civil offense or an infringement of intellectual property rights, or in a manner that would contravene a law or regulation, including legislation governing the medical profession, or disrupt Prelib’s activities;
  • Not to use the Website or the Content, or not to allow or facilitate its use by any person in order to publish any Content which, in the opinion of a reasonable person, constitutes an invasion of the privacy of a person, an attack on the physical or moral integrity of a person or constitutes defamatory, abusive, racist, violent, hateful or intimidating content and not to publish on the Website any Content profaning ethnic insults or homophobic or offensive to any religion or spiritual belief as well as any attack on a particular person or group of persons;
  • Not to use the Website or the Content, or to permit or facilitate its use by any person without reading and accepting the terms of any separate license agreement or conditions provided by Prelib, including other provisions of these Terms, including Section 6;
  • Not to have any employee, supplier, agent or Prelib’s representative make any statement or gesture constituting harassment or abuse, verbal, written or otherwise;
  • Not to create or participate in the creation of a website reproducing, in whole or in part, the Website, the Content or any trademark of Prelib;
  • Not to use the Website or the Content, or not to allow or facilitate its use by any person in order to transmit any communication that, in the opinion of a reasonable person, constitutes advertising, a commercial offer, spam or any form of solicitation;
  • Not to use the Website or the Content, or not to allow or facilitate its use by any person to post Content that a reasonable person might consider to be rude, obscene, indecent, vulgar, or of a sexually suggestive nature or conflicting with the norms of good morals;
  • Not to use the Website or the Content, or not to allow or facilitate its use by any person to render an opinion, diagnosis or medical advice.

Finally, you acknowledge that you are solely responsible for ensuring that your systems are able to use the Website. IT IS RECOMMENDED THAT YOU USE AND UPDATE ANTIVIRUS, ANTI-SOFTWARE SPIES AND FIREWALLS ON YOUR SYSTEMS THAT GIVE ACCESS TO THE WEBSITE.

2. SURVEILLANCE

In order to offer you quality content on the Website, Prelib reserves the right to monitor any Content posted on it by you, as the case may be, to ensure compliance with these Terms.  You hereby consent to such surveillance and monitoring.

Notwithstanding the foregoing, Prelib makes no representations that the Website will be monitored for compliance with these Terms or that it will make any representations in the event of any disagreement with respect to these Terms.

3. COOKIES

Cookies are small text files transferred by a web server to the hard disk of the user of the Website.  Prelib uses cookies on its Websites:

  1. To keep track of the locations you looked for and allow you to return quickly to them the next time you visit the Website;
  2. To enable to proceed with advertising adapted to your latest searches on the Website.

No other information is collected when using these features.  We may also use cookies to ensure that we provide the user with targeted advertising.  However, these cookies do not collect any personal information about the person who uses them.

You can set your browser to accept cookies, to let you know before you accept them, or to refuse them.  If you refuse cookies, please note that some features of the Website, such as recording of your preferences, may not be available.

4. TERMS AND CONDITIONS RELATING TO THE CONTENT

4.1 The Content of the Website is not a reflection of Prelib’s opinion

The opinions, comments or positions contained in the Website represent only the opinions or positions of their authors and at no time should be interpreted as those of Prelib or its third-party suppliers.  You acknowledge that Prelib or its third-party suppliers cannot be held liable and consequently have no liability in relation to any Content generated by a user of the Website, including, more particularly, any defamatory, hateful or otherwise offensive Content, notwithstanding the fact that the content violates these Terms.

4.2 Deletion of Content that does not comply with these Terms

Prelib reserves the right to delete, in its sole discretion, any Content that it deems contrary to these Terms or spirit of these Terms, the whole, without notice.

5. BEHAVIOR OF USERS

5.1 Hacking and reverse engineering

You agree not to infringe or damage the Website.  More particularly, you agree not to overload, disturb, commit hacking, modify the source code of the Website or reverse engineer the Website or any other related software.  In addition, you agree not to interfere with the use of the Website by other users.

5.2 Access to the Website

You agree to only access the Website through the http protocol using an Internet browser.  You agree not to attempt to gain access to Prelib’s servers by any means, including the use of the Administrator account.  You also agree not to expose or allow the use of any Convent on the Website that is not publicly accessible.

5.3 Personal use only

The use and navigation on our Website is solely for your personal use.  You are strictly prohibited from pretending to be a third party by using, creating an account or browsing our Website.  You agree not to open more than one account on the Website.

5.4 Collection of information

You agree not to use any process, software or other automated or manual means or processes to access, collect information, browse, or otherwise scan the Website.

5.5 Use of the Website for an authorized purpose only

You agree not to use the Website for any other purpose, commercial or otherwise, not expressly permitted by these Terms.

THE INFORMATION FOUND ON THE WEBSITE IS PROVIDED FOR INDICATION ONLY AND IS NOT INTENDED TO REPLACE THE ADVICE, DIAGNOSIS OR OPINION OF A PHYSICIAN, PHARMACIST OR ANY OTHER HEALTH PROFESSIONAL.  YOU SHOULD NOT IN ANY WAY IGNORE THE ADVICE OF A HEALTHCARE PROFESSIONAL OR DELAY THE TIME TO GET SUCH ADVICE BECAUSE OF THE CONTENT THAT YOU MAY HAVE READ ON THE WEBSITE.

THIS INFORMATION SHOULD NOT BE USED TO SELF-PRESCRIBING ANY PRODUCTS, TO PREVENT, HEAL OR TREAT A DISEASE, A DISORDER, A PHYSICAL CONDITION OR A MEDICAL CONDITION.

IF YOU RELY ON THE INFORMATION PROVIDED ON THE WEBSITE, YOU DO SO AT YOUR OWN RISK.  YOU SHOULD NOT AT ANY TIME TRY TO SELF-MEDICATE IN CONNECTION WITH ANY CONTENT WHICH IS SEEN OR READ ON THE WEBSITE.  WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, PRELIB SHALL NOT BE LIABLE FOR ANY INJURY OR DEATH CAUSED BY THE USE OR MISUSE OF THE WEBSITE OR ANY CONTENT THEREOF.  IN FACT, SERVICES PROVIDED BY PRELIB THROUGH THE WEBSITE ARE INTENDED TO BE A SCREENING TOOL, WHICH, BY ITS NATURE, IS ADDRESSED TO CLINICALLY ASYMPTOMATIC PERSONS.

7. INTELLECTUAL PROPERTY

7.1 License granted to Prelib

By submitting Content on the Website, you grant us an unlimited, perpetual, transferable and nonexclusive license to the Content so posted on the Website.  You allow us to post it on the Website.  The Content may be reproduced, reused, reposted or modified in any manner or form without your prior consent.

7.2 License granted by Prelib

Because of your browsing of the Website, we grant you a limited and nonexclusive license to the Content, allowing you to display it, print it, for your personal and non-commercial purposes, as well as to share it on the Website as well as on different social networks, subject to your commitment not to modify the Content in any way.  Any other use of the Content is prohibited, including use contrary to what is provided in Section 6 above.  The Content may not be reproduced, reused, reposted in any manner or form except as permitted under these Terms without the prior written consent of Prelib.

All Content on the Website belongs to Prelib or belongs to the owner identified by Prelib, and is protected by applicable laws, including copyright laws.  You may not copy, reproduce, publish, repost, transmit or otherwise use any of them without our prior written consent, other than in accordance with these Terms.

In addition, all trademarks, whether registered or not, and all trade names contained on this Website belong to Prelib or to the holder who has validly granted a license to use.

You acknowledge that the Website may use third party websites, including Facebook, Twitter and Instagram.  These websites are governed by their own terms of use, which do not replace or waive these Terms.

Finally, you acknowledge that the inclusion of such links does not imply that Prelib is sponsoring trademarks, trade names, designs, logos, symbols or other copyrighted material posted on them, or that Prelib is affiliated or associated or that Prelib is legally entitled to use it.

9. INDEMNITY

To the extent permitted by law, in the event of any claim by a third party to Prelib or its representatives or agents in connection, directly or indirectly, with the violation of these Terms by you, you agree to take facts and cause for Prelib and to keep it free and unharmed from any loss in connection with such claims, including legal fees.

10. EXCLUSION OF WARRANTIES AND LIMITATION OF LIABILITY

PRELIB TRIES TO PROVIDE THE WEBSITE IN A SECURE FRAMEWORK AND IN AN ENVIRONMENT WITHOUT DEFAULT OR ERROR. 11. GENERAL PROVISIONS

11.1 Failure – Default

Failure or delay by Prelib to exercise any right, remedy or lien under these Terms shall not constitute a waiver of such right, remedy or lien.  Similarly, Prelib is in no way barred from exercising at a later date any right, remedy or privilege that it has not previously exercised, in whole or in part.

11.2 Applicable law

These Terms, their interpretation, their performance, their application, their validity and their effects are subject to the laws in force in the Province of Quebec and to the laws in force in Canada applicable in the Province of Quebec governing in part or in their entirety all the provisions they contain.  To the extent permitted by law, any claim, directly or indirectly, hereunder shall be submitted to the exclusive jurisdiction of the courts of Quebec, excluding the courts of any other jurisdiction.

11.3 Amendments

Prelib reserves the right, in its sole discretion, to modify the Website, the Content and these Terms at any time without notice.  When amendments are made to the Terms, Prelib agrees to change the date of last update appearing above.  By continuing to browse the Website, you agree to be bound by these Terms, including any amendments thereto.  Otherwise, your only recourse is to stop using the Website.

 


Our netiquette

We wish to cultivate healthy and positive discussion among our online community. For this reason, Prelib’s netiquette is a set of unofficial rules of conduct that should be exercised and respected on the organization’s various social platforms.

Prelib encourages all people from diverse backgrounds to get involved, regardless of their sexual and gender identity, religious beliefs, ethnocultural background, age, or belonging to minority groups.

In an effort to foster thoughtful and respectful dialogue, we invite users to rely on this netiquette.

Our social media presence (Facebook and Instagram) provides us with the opportunity to connect with our audiences and participate in discussions as long as they adhere to our values of openness, integrity, transparency, inclusion, and kindness.

Monitoring Period

Our team monitors incoming messages and comments on our various social platforms from Monday to Friday between 9 a.m. to 5 p.m. (some exceptions, such as stat holidays, apply). If you write to us in the evening or during the weekend, we will respond the following business day.

Specific requirements for social media 

We request that anyone who wishes to participate in online discussions respect the following:

  • Comments must be related to Prelib and/or its content.
  • Appropriate and inoffensive language should be used at all times.
  • No form of discrimination will be tolerated. Content must not harm any individual, their reputation, group, or organization.
  • All users must engage respectfully with one another, whether directed at other followers, the Prelib team, or individuals featured in our content. Any comment violating the codes of conduct may be deleted.
  • Prelib reserves the right to delete comments that contain hyperlinks to sites whose authenticity and credibility cannot be verified.
  • It is strictly prohibited to publish content likely to offend or risk exposing a person or a group of people to hatred or contempt on grounds based on their sexual and gender identity, religious belief, ethnocultural background, age, whether they belong to minority groups or any other reason.
  • Any comment or content may be deleted if it contains the following:
    • illegal material (for example, in violation of a court order);
    • hate speech;
    • threats or harassment;
    • personal attacks, insults or defamatory content;
    • incitement to commit a criminal act;
    • an attempt to mobilize a group of people for any cause other than an event orchestrated by Prelib; and/or
    • messages conveying beliefs that do not stem from a scientific, rigorous and nuanced approach (fake news).
  • All content must respect privacy and be free of personal information (such as a phone number or email address) or parts of a private conversation.
  • Content of a commercial nature, such as promotions and press releases, will be rejected.

Prelib may delete posts and comments deemed inappropriate at any time.

Anyone violating our netiquette will have their comments deleted, and their account could be blocked. Prelib reserves the right to close a forum without notice, to refuse to publish content, and not to address a given subject.
 


 

PRÉLIB’S PRIVACY POLICY

This privacy policy (hereinafter the “Policy”) details how Prélib Inc. (hereinafter the “Corporation” or “Prélib”) collects, uses, discloses, retains and disposes of your Personal information, in order to regulate the governance of such personal information within the Corporation. To make this Policy easier to read, we will use the term “we” from time to time to refer to the Corporation.

In certain cases, we may provide you with additional information regarding the processing of your Personal information at the time of the collection.

We may also obtain your specific consent in certain cases relating to the collection, use, disclosure and retention of your Personal information.

The Policy applies to the personal information we collect, regardless of the manner, whether it be in person, by telephone, by videoconference or via our website.

By accepting this Policy or by providing personal information to us after having had the opportunity to consult said Policy, or any other supplementary notice, you agree that your Personal information will be processed in accordance with the Policy and any supplementary notice, if applicable.

The Corporation is a self-collection center that offers prevention and screening services for sexually transmitted and blood-borne infections in a simple and quick manner. Several healthcare professionals, including doctors, nurses and pharmacists, collaborate to assess, guide and treat patients. These professionals also provide medical follow-ups to ensure continuous services.

We train and raise awareness among staff members and healthcare professionals, including through occasional activities and training sessions, and by implementing practices and policies in this regard. We ensure that staff members and various stakeholders are aware of said policies and practices. We also ensure that they rigorously apply them to their tasks and functions.

All of our employees who handle your Personal information are bound by confidentiality obligations. Furthermore, they can only have access to the Personal information necessary to carry out their respective duties and functions. In the event of a non-compliance, our governance policies and practices provide for sanctions.

2. Definitions

For the purposes of the Policy and any other document arising from or relating to it, the following words and expressions have the meaning given to them below, unless otherwise indicated :

“Privacy Incident” means (i) unauthorized access to personal information by law, (ii) the unauthorized use of personal information by law, (iii) the unauthorized disclosure of personal information by law; or (iv) the loss of personal information or any other breach of the protection of such information;

“Personal Information” means information allowing the identification of an individual, such as their first name, last name and address, as well as any information or data that the Corporation’s servers may contain due to the functionalities offered by it.

3. Processing and Use of Personal Information

The Corporation uses a unified technological platform for the operation and management of its medical clinic (hereinafter the “Platform”), in particular to collect, store and process patients’ Personal information and to offer all its services online.

We use Personal information solely for the purposes of our activities, namely:

Patient Records

We use Personal information to share patient files among the different stakeholders involved via the Platform. A patient file contains, among other things, the Personal information required for the identification of a patient, the relevant data from screening tests as well as the overall profile related to sexual habits. This use of Personal information allows the Corporation to provide effective medical follow-ups. Patients have access to their Personal information directly on their profile via the Platform. Health professionals may also add medical notes to a patient’s file. Various laboratories also collect Personal information required to analyze tests and share the results with other stakeholders and patients concerned.

Email and Text Notification System

We use the required Personal Information in order to provide you automated reminders regarding behaviours to adopt and screening measures. We also use the required Personal information to automatically schedule appointments (phone call, videoconference, in-person appointment, etc.) with healthcare professionals chosen by the patient, as well as to create availability schedules.

PrEP solution (services related to taking the PrEP medication)

We use the required Personal information to provide medication reminders, schedule deliveries, program recurring medication intake and conduct follow-ups in this regard.

Technical support

In the event that you request assistance from the support team, your Personal information will be used to contact you.

Ensuring Patient Identification

We also use Personal information required to identify an user and to ensure the authenticity of this identification.

We also reserve the right to use the required Personal information to monitor the quality of our services and improve your experience.

Registration via the Platform

We collect your Personal information when you register on the Platform and enter your information by completing online questionnaires regarding your sexual health or eligibility for PrEP services (PrEP Solution).

We collect your Personal information solely for the purposes of our activities described above. Please refer to the information above regarding the usefulness of collecting your Personal information.

Retention Period of Personal Information

We will destroy your Personal information once the purposes for which we collected or used it have been fulfilled, subject to retention periods prescribed by law. In this regard, we retain the required Personal information in order to comply with applicable laws regarding the keeping of medical records, including notably the “Règlement sur les dossiers, les lieux d’exercice et la cessation d’exercice d’un médecin” and the “Règlement sur les effets, les cabinets de consultation et autres bureaux des membres de l’Ordre des infirmières et infirmiers du Québec”.

Access to Personal Information and Sharing of Personal Information with Third Parties

Retention and Storage of Personal Information

The Personal information required to offer our services via the Platform is stored on the servers of Amazon Web Services, Inc. (“AWS”). You can consult the following hyperlinks to learn more about the security measures implemented by AWS :

4. Providers and Technological Products Used

As part of its activities, the Corporation retains the IT services of a provider that offers the services of the Platform to the Corporation. The Corporation transfers Personal information on the Platform in accordance with this Policy.

Different subcontractors are used to operate the Platform (collectively the “Platform Subcontractors”).

Corporation Providers

4.1. Platform Service Provider

The Platform is the technological tool used by the Corporation to offer all its health services online.

4.2. Web Development

The Corporation retains the services of a web development provider in order to develop and support its technological tools. This provider may have access to Personal information from time to time for the sole purpose of providing its services, but cannot however copy or retain this information. Moreover, we use access logging through their services.

Plateform Subcontractors

4.3. Amazon Web Services, Inc. (“AWS”) – Data Hosting

The required Personal information to offer our services via the Platform is hosted on AWS servers, as described above.

4.4. Block, Inc. (“Square”) – Payment and Financial Services Platform

Square’s services are retained during a transaction in a Prélib clinic (physical terminals), more specifically when the patient pays sample collection transportation fees. These services are secured in particular by two-factor authentication. The Personal information collected are the last four (4) digits of a credit card, an email address and a telephone number. The staff involved who can access this information are Prélib’s nurses, members of the management team and our external accountants.

4.5. Stripe, Inc. (“Stripe”) – Online Payment Processing Platform

Stripe’s services are retained during an online transaction on the Platform for consultation or missed appointment fees. These services are secured in particular by two-factor authentication. Only our employees directly assigned to monitoring these transactions have access to it. The Personal information shared with Stripe is a patient’s first and last name and invoice number.

4.6. Medical Billing Agency

The Corporation retains the services of a medical billing agency authorized by the “Régie d’assurance-santé du Québec” (“RAMQ”) for the purposes of medical billing. The Personal information collected is the last name, first name, health insurance number, first and last name of the attending physician and the billing code managed by the RAMQ. Only Platform’s administrators and the development team can access this information. Furthermore, only administrator accounts have access to this section of the Platform.

4.7. Cloud Phone Services

The Corporation retains the services of a cloud communications service provider. The only data shared with this provider is Personal information exchanged during calls (voice call or videoconference) made online via the Platform. These services are secured in particular by two-factor authentication. Only a few employees of the Corporation have access to this information.

4.8. Communication software

The Corporation retains the services of a communication software provider. The services of this provider are used to communicate with Prélib’s patients by email, via the Platform, as well as to communicate information following patient requests. The Personal information collected is a patient’s last name, first name, residential address and email address.

4.9. Microsoft Canada Inc. (“Microsoft Office”)

The Corporation and the parties involved in a file use the Microsoft Office suite, including the TEAMS and Outlook applications, in particular to carry out the general activities of the Corporation. For example, the required Personal information is shared on certain technological tools of the Microsoft Office suite during exchanges between professionals, employees and patients.

4.10. Transportation of samples to laboratories

Several sample transports are carried out between the Prélib’s clinics and provincial laboratories by transporters or employees of the Corporation who are authorized for this purpose by said provincial laboratories. The Personal information used to identify the samples is the last name, first name, date of birth, Quebec health insurance number (RAMQ) and the list of medical tests completed by a patient.

4.11. Fax

The Corporation may transmit and receive faxes in particular to obtain laboratory results concerning medical tests completed by a Prélib’s patient. Employees of the Corporation can receive the Personal information by fax, including the last name, first name, Quebec health insurance number (RAMQ) and analysis results.

5. Governance, Safety Measures and Inherent Risks

We have implemented various measures taking into account the sensitivity of Personal information and its use. We follow industry security standards to protect the Personal information we collect and receive.

In particular, we put in place appropriate physical, technical, IT and administrative safeguards to protect your Personal information against a Privacy Incident.

5.1. Technical and organizational measures implemented by the provider of the Plateform

Amazon’s services were retained to optimize the physical and software security of the infrastructures of the Plateform.

Furthermore, the Corporation and its main provider, through the Platform, use various tools and measures to protect your Personal information :

  • Principle of least access privilege;
  • Use of IP addresses to restrict access to data servers;
  • Biannual security audits;
  • Two-factor authentication for our employees;
  • Logging, monitoring and management of application errors;
  • Web application firewall;
  • Encrypted database : AES-256 encryption of stored data.

5.2. Security measures taken during the sharing of data exchanged between different stakeholders and providers

The sharing of Personal information is carried out through the protocol commonly known as HTTPS (HyperText Transfer Protocol Secure), which allows you to verify the identity of the website you are accessing using a reliable third-party authentication certificate.

Despite these measures, given the risks inherent in the use of computer systems, we cannot ensure or guarantee the security and confidentiality of the Personal information that you share or provide to us. 7.1. In the case of a serious risk of death or serious injury

We may disclose personal information in our possession in order to protect an individual or group of individuals when there is reasonable cause to believe that a risk of death or serious injury, as a result of a disappearance or an act of violence, including a suicide attempt, and the nature of the threat inspires a sense of urgency.

11. Fully Automated Suggestions

When a patient completes an online medical questionnaire via the Platform portal, sample collection tests are automatically suggested based on the responses obtained. A patient can obviously accept or refuse the tests offered to him. This method allows us to offer to our patients fast and friendly services. It should be noted that a patient’s attending physician always has the right to review the tests that are recommended to a patient. Indeed, doctors healthcare professionals always analyze each situation and use their professional judgment to determine whether the proposed test or suggestions are adequate. They can always decide not to follow the proposed test or suggestions and to propose other tests.

Furthermore, following an appointment for a test, we automatically send the patient concerned an invitation to schedule a telephone appointment using the personal information recorded in his file.

We may, from time to time, amend the Policy to reflect changes in our business procedures or in the law.
